Terms and Conditions

For HCD-Approved Park Manager Training Course ONLY

Effective Date: February 26, 2026

1. Overview

These Corporate and Group Licensing Terms and Conditions (“Terms”) govern the purchase and use of bulk course licenses/Seats (“Seats/Licenses”) for The MH Trainer’s HCD-Approved Park Manager Training Course (“Course”), offered by Hitchens Enterprises LLC, doing business as The MH Trainer (“Provider,” “we,” “our”). By submitting a purchase order, invoice request, or payment for multiple Seats/Licenses, the purchasing entity (“Company,” “you,” “your”) agrees to be bound by these Terms in addition to The MH Trainer’s general website Terms of Use and Privacy Policy.

2. Seat/License Pricing & Volume Discounts

All pricing is per Seat/License, per learner, for one-time access to the Course. Volume discounts are applied based on the total number of Seats/Licenses purchased in a single transaction. Seats/Licenses may not be accumulated across multiple orders to qualify for a higher discount tier.

Pricing is subject to change. However, any pricing quoted on a formal invoice or purchase order will be honored for thirty (30) days from the date of issuance.

3. Accepted Payment Methods

3.1 Credit or Debit Card (All Orders)

All orders, regardless of size, may be paid via credit or debit card. Card payments are processed securely through Stripe. Course access is granted immediately upon successful payment authorization.

3.2 ACH Bank Transfer (All Orders)

ACH bank transfers are available for all orders. ACH payments are processed through Stripe’s ACH payment system. Please allow three to five (3–5) business days for ACH transfers to clear. Course access will not be granted until the ACH transfer has fully cleared and funds have been confirmed.

3.3 Invoicing (5+ Seats/Licenses)

Companies purchasing five (5) or more Seats/Licenses may request a formal invoice. To request an invoice, contact us at the email address listed on our website. Invoices will include the Company name, number of Seats/Licenses, applicable pricing tier, total amount due, and payment instructions for all accepted methods (credit/debit card or ACH). Full payment must be received and cleared before any course access is provisioned. Invoices are valid for thirty (30) days from the date of issuance. Expired invoices may be subject to updated pricing.

4. Payment-First Access Policy

No course access, Seat/License activation, or learner enrollment will occur until full payment has been received and confirmed. This applies to all payment methods without exception. The Provider is not obligated to hold or reserve Seats/Licenses pending payment. Seat/License availability and pricing are subject to change until payment is confirmed.

5. Seat/License Assignment & Learner Enrollment

5.1 Learner Information Requirements

Upon payment confirmation, the Company must provide the following information for each learner to be enrolled: full legal name, valid email address, park name, HCD-issued Park ID number, park address, and mailing address for the certificate. This information is required by the California Department of Housing and Community Development (HCD) for course completion certification. The Company is solely responsible for ensuring the accuracy and completeness of all learner information provided.

5.2 Seat/License Assignment

Each Seat/License is assigned to one (1) named individual. Once a Seat/License has been assigned and the learner has been enrolled in the Course, the Seat/License is non-transferable and cannot be reassigned to a different individual. If a learner has not yet been enrolled (i.e., no learner information has been submitted and no course access has been created), the Company may reassign that unused Seat/License to a different individual, subject to the license expiration terms in Section 6.

5.3 One Learner Per Seat/License

Each Seat/License grants access to one (1) individual only. Sharing login credentials, allowing multiple individuals to use a single Seat/License, or any form of unauthorized access is strictly prohibited and constitutes a material breach of these Terms. The Provider reserves the right to immediately revoke access and forfeit the Seat/License without refund if credential sharing or unauthorized use is detected.

6. License Validity & Expiration

All purchased Seats/Licenses must be assigned, activated, and completed within ninety (90) days from the date payment is confirmed (“License Period”). Any Seats/Licenses not assigned, activated, and completed within the License Period will automatically expire and are forfeited without refund. The Provider is under no obligation to send reminder notices regarding upcoming expirations, though we may do so as a courtesy. Requests for extensions may be considered on a case-by-case basis at the sole discretion of the Provider.

7. Refund & Cancellation Policy

7.1 Before Access: If the Company requests a cancellation before any Seats/Licenses have been activated (i.e., before any learner has been enrolled and has accessed the Course), a full refund will be issued minus a 5% administrative processing fee. Refunds will be returned via the original payment method within ten (10) business days.

7.2 After Access: Once a learner has been enrolled and has accessed any portion of the Course content, that Seat/License is non-refundable. For partial-use orders (e.g., a Company purchases 20 Seats/Licenses but only 12 have been activated), refunds may be issued only for unactivated Seats/Licenses, subject to the 5% administrative processing fee and at the sole discretion of the Provider.

7.3 Expired Seats/Licenses: Seats/Licenses that expire under Section 6 are not eligible for refund.

8. Course Completion & Certification

Upon successful completion of the Course, each learner will receive a Certificate of Completion as approved by the California Department of Housing and Community Development (HCD). Certificates are issued in the learner’s legal name as provided at enrollment and mailed to the address provided by the Company. The Provider is not responsible for delays or issues caused by inaccurate learner information provided by the Company. It is the Company’s responsibility to ensure all required learner data (including park name, HCD-issued Park ID number, park address, and mailing address for the certificate) is accurate and provided in a timely manner.

9. Intellectual Property & Course Content

All Course content, materials, videos, assessments, handouts, and associated resources are the exclusive intellectual property of The MH Trainer and are protected under U.S. copyright law. The purchase of Seats/Licenses grants a limited, non-exclusive, non-transferable license for assigned learners to access the Course for personal educational purposes only. The Company and its learners may not reproduce, distribute, record, screenshot, share, resell, sublicense, or create derivative works from any Course content. Unauthorized use or distribution of Course materials will result in immediate termination of access and may result in legal action, including claims for damages under the Digital Millennium Copyright Act (DMCA).

10. Company Responsibilities

The Company agrees to the following obligations:

       Provide accurate and complete learner information for each Seat/License within the 90-day License Period.

       Ensure that each learner uses only their own assigned login credentials.

       Designate a primary Company contact who will serve as the liaison for all enrollment, billing, and communication matters.

       Inform learners of the Course requirements, expectations, and these Terms prior to enrollment.

       Comply with all applicable laws and regulations, including those set forth by the California Department of Housing and Community Development.

11. Limitation of Liability

The Course is provided “as is” for educational purposes. While the Provider makes every effort to ensure the accuracy and quality of Course content, the Provider makes no warranties, express or implied, regarding the Course’s fitness for a particular purpose. The Provider’s total liability arising from or related to these Terms shall not exceed the total amount paid by the Company for the Seats/Licenses in question. The Provider shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits or business interruption.

12. Termination

The Provider reserves the right to terminate any or all Seats/Licenses immediately, without refund, if the Company or any of its learners: (a) violate any provision of these Terms; (b) engage in credential sharing or unauthorized access; (c) reproduce, distribute, or misuse Course content; (d) provide fraudulent learner information; or (e) engage in any activity that disrupts the Course platform or other learners’ experience.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved within thirty (30) days, disputes shall be resolved through binding arbitration administered in the State of California in accordance with the rules of the American Arbitration Association. Each party shall bear its own costs and attorney’s fees unless otherwise awarded by the arbitrator.

14. Modifications to These Terms

The Provider reserves the right to update or modify these Terms at any time. Changes will be posted on The MH Trainer website and will apply to all new orders placed after the effective date of the change. Existing, paid orders will be governed by the Terms in effect at the time of purchase.

15. How to Place a Corporate/Group Order

To purchase Seats/Licenses for your organization, please follow these steps:

1.     Contact Us: Email us at the address listed on themhtrainer.com with your company name, number of Seats/Licenses needed, and preferred payment method.

2.     Receive Your Invoice: We will send a formal invoice with your pricing tier, total amount, and payment instructions.

3.     Submit Payment: Pay via credit/debit card or ACH bank transfer as outlined in Section 3.

4.     Provide Learner Information: Once payment clears, send us the required learner details (full legal name, email, park name, HCD-issued Park ID number, park address, and mailing address for the certificate) for each Seat/License.

5.     Learners Are Enrolled: We will enroll each learner and they will receive login credentials to access the Course.
